Supreme Court Decision: GVH Ruling Against Nitrogénművek Annulled, Fine Reimbursed
The Supreme Court (Kúria) has rejected the request for judicial review submitted by the Hungarian Competition Authority (GVH), as the case did not raise any legal issues requiring guidance from the highest court. Consequently, there was no justification for conducting an extraordinary remedy procedure.
The final ruling established that the GVH’s decision was unlawful and, therefore, annulled it. As a result, the Court of First Instance ordered the GVH to conduct a new procedure.
Following the ruling, the fine previously paid by Nitrogénművek, along with accrued interest, has already been reimbursed.
Thus, the previous competition law findings against Nitrogénművek can no longer be considered valid.
As a last resort, the parties have submitted a petition for uniformity of law, while the GVH has already initiated the repeated procedure.
